1. About this Policy

To ensure our network and services remain reliable and available to all customers, we have developed this Acceptable Use Policy (AUP). It helps ensure that all customers have fair access and that our network is not misused or disrupted.

We aim to provide generous service terms, but we rely on all customers to use our network responsibly. If you or anyone using your service breaches this Policy, we may suspend, restrict, or cancel your service in accordance with our General Terms.
2. Prohibited Use
2.1
You, and anyone who uses your service, must not use or attempt to use the service:
(a) for any illegal, unlawful or fraudulent activity;
(b) for any use we have advised you is not permitted in your application or service description;
(c) in a way that interferes with, disrupts, or threatens the performance or security of our network or any supplier’s network;
(d) in a manner that may cause injury, damage property, or endanger anyone’s safety;
(e) to transmit, post, or communicate material that is abusive, harassing, threatening, defamatory, or otherwise offensive;
(f) to abuse, harass or intimidate our staff or representatives;
(g) to make inappropriate contact with minors;
(h) to copy, share, or distribute material that infringes on any copyright, patent, trademark, or other intellectual property rights;
(i) to send or relay data designed to conceal or misrepresent its origin in a deceptive or malicious manner (excluding lawful VPN use);
(j) to gain unauthorised access to, or interfere with, another person’s network, account, data, or systems;
(k) to attempt to breach, test or bypass any security system or authentication process;
(l) to distribute or use software designed to compromise network or system security, such as viruses, malware, or keyloggers;
(m) to engage in fraudulent schemes, scams, or misleading business practices;
(n) to engage in any unreasonable activity that disrupts other users or networks (such as denial-of-service attacks or intentional network flooding); or
(o) to access, store, distribute or publish material that is prohibited or restricted under any Australian law or classification system, including content unsuitable for minors.
2.2
You must not use our hosting or web services to store or process credit card information unless we have provided express written consent to do so.
3. Unreasonable Use
3.1
You must not use your service in a way that we reasonably consider:
(a) deliberately causes network congestion, instability, or disruption;
(b) interferes with another person’s ability to use our services or network;
(c) involves resupplying or reselling the service without our written approval; or
(d) is inconsistent with the intended use of the service (“non-ordinary use”).
3.2
Non-ordinary use includes, but is not limited to:
(a) using a residential service for business or commercial purposes without approval;
(b) using a business service to operate a telemarketing or call centre without consent;
(c) connecting unapproved hardware or software to our network;
(d) using the service to harass, menace or injure any person; or
(e) using the service in any way that breaks the law, a code, or industry standard.
3.3
If we reasonably believe your use is non-ordinary, we may contact you to discuss or request that you reduce your usage. Continued non-compliance may result in suspension or termination of your service without further notice.
4. Excessive Use
You must stay within any data, speed, or usage limits that apply to your chosen plan. We may manage, limit, or suspend your service if your use is excessive, unreasonable, or impacts other customers or the integrity of our network.
5. Spam
5.1
“Spam” includes one or more unsolicited commercial electronic messages with an “Australian link” as defined under the Spam Act 2003 (Cth).
5.2
You must not use your service to:
(a) send or assist in sending Spam;
(b) use or distribute software designed to harvest email addresses; or
(c) otherwise breach the Spam Act 2003 or any related regulations.
6. Security
You are responsible for maintaining the security of your service, including safeguarding passwords and protecting against unauthorised access. We recommend using a firewall and up-to-date anti-virus software.
You are responsible for all usage of your service, including any charges incurred by people you allow to access it.
7. Copyright and Intellectual Property
It is illegal to download or share copyrighted material without permission from the copyright owner. You must ensure that your use of our service does not infringe on the intellectual property rights of others.
If we have reasonable grounds to believe you are infringing a third party’s copyright, we may request that you cease the activity. Repeated or continued infringement may result in suspension or termination of your service.
8. Content and Online Conduct
You are responsible for the content you access, store, send, or publish using our services.
You must not use the service to:
(a) distribute or host offensive, obscene, or unlawful material;
(b) make inappropriate contact with minors; or
(c) enable access to restricted content in violation of Australian law.
You are also responsible for supervising minors who use your service and for implementing appropriate content filters if required.
If we suspect that your service has been used to access or distribute child abuse or exploitation material, we are required by law to refer the matter to law enforcement authorities.
9. General Responsibilities
9.1
You must take reasonable steps to prevent unauthorised use of your service, including by:
(a) installing and maintaining security software and firewalls;
(b) keeping your devices, systems and software up to date;
(c) protecting your passwords and Wi-Fi network;
(d) ensuring others who use your service comply with this Policy; and
(e) for business customers, maintaining internal usage policies consistent with this Policy.
9.2
We may suspend, limit or cancel your service—whether or not the breach was intentional—if we reasonably believe your service has been used in breach of this Policy, including via malware or unauthorised access.
10. Changes to this Policy
We may update this Acceptable Use Policy from time to time. The latest version will always be available on our website. Continued use of our services after changes are made means you accept the updated Policy.
